TERMS AND CONDITIONS

1. Introduction

Bozarhaat is a digital marketplace platform operated under the procedural and governance framework of National Practical Centre (NPC). The platform facilitates buying and selling of goods and services between verified farmers, producer groups, service providers, wholesalers, institutions, and consumers.

Bozarhaat may be integrated with the Open Network for Digital Commerce (ONDC) for enabling broader market connectivity.

By accessing or using Bozarhaat, you agree to be bound by these Terms and Conditions.

2. Definitions

For the purpose of this Agreement:

• Platform means Bozarhaat digital marketplace.
• Operator means National Practical Centre (NPC).
• User means any registered individual or entity using the platform.
• Producer means an actual farmer, artisan, manufacturer, or primary producer.
• Service Provider means a verified individual or group providing lawful services.
• Wholesaler/Trader means an authorised buyer or reseller registered on the platform.
• ONDC Linked Services means transactions routed through or interoperable with ONDC protocols.

3. Eligibility

• All users must be real, identifiable human beings or legally registered entities.
• Each user must maintain a definite and verifiable profile.
• Users agree to provide accurate identity, address, bank, and business information.
• Quarterly profile updates are mandatory as per NPC procedure.

NPC reserves the right to suspend or terminate accounts for false or misleading information.

4. Nature of Platform

• Bozarhaat acts as a facilitator and marketplace enabler.
• The platform does not take ownership of goods unless specifically stated.
• Transactions are conducted directly between buyer and seller.
• NPC does not guarantee sales volume, pricing, or business performance.

5. User Obligations

All Users agree:

• To comply with applicable Indian laws, including consumer protection, taxation, food safety, and trade regulations.
• Not to list prohibited, illegal, counterfeit, or misrepresented goods.
• To maintain ethical trade practices.
• To fulfil confirmed orders in good faith.
• To ensure service delivery standards as declared in their profile.

6. Profile Verification & Quarterly Update

• Every User profile shall be reviewed and updated quarterly.
• The update process may include:
  • Identity verification
  • Business activity verification
  • Product/service category validation
  • Bank account confirmation
• Non-compliance may result in temporary suspension.

NPC reserves the right to conduct physical or digital audits.

7. Pricing & Payments

• Sellers determine their own pricing.
• Platform service charges (if any) will be transparently disclosed.
• Payments may be processed via:
  • Direct transfer
  • ONDC-linked gateways
  • Escrow or settlement systems (where applicable)

NPC shall not be liable for third-party payment gateway failures.

8. ONDC Integration

Where transactions occur through ONDC-linked systems:

• Users agree to comply with ONDC operational guidelines.
• Settlement timelines may be governed by ONDC network protocols.
• Interoperability disputes shall be resolved under ONDC framework where applicable.

Bozarhaat remains an independent platform integrated with ONDC but not controlled by it.

9. Product & Service Liability

Producers and service providers are solely responsible for:

• Product quality
• Compliance certifications
• Service execution

NPC shall not be liable for:

• Product defects
• Service deficiencies
• Delays caused by third-party logistics

Disputes shall first be attempted to resolve mutually. NPC may act as a mediator but not as a guarantor.

10. Intellectual Property

• Bozarhaat name, branding, and system architecture are proprietary.
• Users retain ownership of their product content and images.
• Users grant Bozarhaat non-exclusive rights to display their listings.

Unauthorized use of platform branding is prohibited.

11. Data Protection & Privacy

• Personal data shall be processed in accordance with applicable Indian data protection laws.
• User contact details may be masked for security.
• Data may be used for:
  • Verification
  • Reporting
  • Impact measurement
  • Institutional collaboration

NPC shall not sell personal data.

12. Suspension & Termination

NPC may suspend or terminate access if:

• False information is provided
• Illegal activities are detected
• Repeated consumer complaints occur
• Quarterly compliance is ignored

Users may request account deactivation in writing.

13. Limitation of Liability

Bozarhaat and NPC shall not be liable for:

• Indirect or consequential damages
• Loss of profit
• Network failures
• ONDC technical disruptions
• Force majeure events

Maximum liability shall be limited to platform service charges received in the specific transaction.

14. Dispute Resolution

• Disputes shall first be resolved through internal mediation.
• If unresolved, jurisdiction shall lie within courts of Assam, India.
• Applicable law: Laws of India.

15. Amendments

NPC reserves the right to update these Terms periodically. Continued use of the platform constitutes acceptance of updated Terms.

16. Declaration

By registering on Bozarhaat, the User declares that:

• They are an actual human individual or legally registered entity.
• All information provided is true and correct.
• They agree to quarterly profile compliance under NPC procedure.
• They understand Bozarhaat is a facilitative platform.
